ISO New England reserves the right to cancel, terminate, or restrict your access to the app for any reason or no reason, without notification. ISO New England may also change these Terms and Conditions, which changes will become effective immediately after posting, which you agree is a reasonable means of providing notice. ISO New England may issue updates to the app, at its sole discretion, but is not obligated to maintain or support it.
The terms of agreement with your respective mobile network provider will continue to apply when using the app. As a result, you may be charged by the mobile provider for access to network connection services for the duration of the connection while accessing the app or any such third party charges as may arise. You acknowledge and accept sole responsibility for any such charges that arise.
ISO New England may collect and retain device ID information for the purpose of detecting excessive usage. If ISO New England, in its discretion, determines that there is excessive usage, it may take any and all actions to mitigate potential degradation of service, up to and including employment of a throttling mechanism.
These Terms and Conditions, your performance under these Terms and Conditions and any disputes arising under these Terms and Conditions shall be governed exclusively by the laws of the United States of America and the Commonwealth of Massachusetts, without giving effect to conflicts of laws principles. You expressly consent to the exclusive forum, jurisdiction, and venue of the Court for the Commonwealth of Massachusetts and the United States District Court in Massachusetts in any and all actions, disputes, or controversies relating to this Agreement.
